AirCode Ø Marketplace Visitor Terms

Version 1.1 — effective September 4, 2026.

These AirCode Ø Marketplace Visitor Terms (the “Terms”) are an agreement between Spartacus lab SARL, a Swiss limited liability company with its registered address at 32 route du Vallon, 1224 Chêne-Bougeries, Switzerland (“Spartacus lab”, “we”, “us”, or “our”), and each person who browses a Marketplace listing or tries, installs, buys, or otherwise uses a listed app (“Visitor” or “you”).

By using AirCode Ø Marketplace, you agree to these Terms. If you do not agree, do not use the Marketplace or continue to a listed app. The AirCode Ø End User License Agreement separately governs use of the AirCode Ø software; it does not turn a third-party Marketplace app into Spartacus lab software.

1. Third-party apps

Marketplace apps are created, provided, operated, and changed by independent third-party publishers. The publisher’s public handle and display name appear on the listing. Unless a listing expressly says otherwise, a publisher is not Spartacus lab’s employee, agent, partner, or representative, and the app is not endorsed by Spartacus lab.

The central Marketplace stores and serves bounded listing information and normalized images. The app itself runs on the publisher’s computer and is reached through a managed-Relay connection. Spartacus lab does not centrally host or execute the app’s code.

Before the first Try, Install, or Buy action, the Marketplace asks you to confirm that you choose to trust the identified third-party publisher. That confirmation is a warning and an informed handoff; it is not a security certification or a transfer of the publisher’s responsibilities to you.

2. No code review or certification

AirCode Ø has not reviewed or certified a Marketplace app’s code. Marketplace review concerns the publisher’s submitted listing representation and may include bounded technical or safety checks. It does not establish that an app is secure, private, lawful, accurate, continuously available, free of malware, fit for a purpose, or approved by a native app store or regulator.

An app can change on the publisher’s computer after its listing was reviewed. Automated monitoring, reports, moderation, or a lack of reported problems does not guarantee that a later version is safe. You should evaluate the publisher, the app’s own terms and privacy notice, the information it requests, and any download or external destination before proceeding.

3. Browser and installation boundary

A listed app is delivered as a web app in a browser context. Installing it to a Home Screen does not convert it into native software reviewed by a mobile app store. Browser and operating-system controls govern installation, permissions, storage, notifications, and removal.

Do not enter a password, recovery phrase, one-time code, private key, payment credential, sensitive personal data, or other secret unless you independently trust the publisher, understand why the app needs it, and are satisfied with the app’s disclosures and safeguards. Treat unexpected downloads and requests to disable security warnings as unsafe.

Removing, unlisting, or suspending a central listing stops new Marketplace handoffs but may not remove an already installed Free PWA, delete browser data, cancel a notification subscription, or make the publisher’s origin unreachable by every other route. Use your browser or operating-system controls to remove an installed app and its permissions, and contact the publisher about data the publisher controls.

4. Publisher terms, privacy, and app data

The publisher may provide separate app terms and a privacy notice. Those terms are between you and the publisher. The publisher, not Spartacus lab, is responsible for the app’s accounts, content, outputs, services, support, security, privacy practices, data collection, retention, and deletion.

The Marketplace listing does not authorize an app to collect data. Review the in-app disclosure before providing information. Spartacus lab does not receive app form values, credentials, project data, app-created data, Push endpoints, or notification content merely because you use a Marketplace handoff.

5. Availability, links, downloads, and transactions

Apps run on publisher-controlled systems and may be changed, interrupted, withdrawn, or become unavailable without notice. We do not guarantee that a listing, Relay connection, app, source repository, donation provider, download, external link, or third-party service will remain available or unchanged.

An external donation is between you, the publisher or recipient, and the named payment provider. It does not purchase access, create an entitlement, or make Spartacus lab responsible for the recipient. Production Paid apps are not available until separate buyer, seller, payment, refund, tax, trader-disclosure, and Commerce terms are enabled. Those terms will control a purchase if they are later presented and accepted.

You are responsible for checking an external destination and complying with applicable law. Do not use the Marketplace or an app to violate rights, evade security, or engage in unlawful conduct.

6. Star ratings

If you sign in to an AirCode Ø account, you may submit one integer star rating from one to five for an eligible Marketplace app. You may change or delete your rating. You may not rate your own listing, create or use accounts to manipulate an aggregate or ranking, coordinate deceptive ratings, or offer or accept compensation for a rating.

A rating is an opinion about the listing and app. It is not proof that the rater installed or used the app, and it is not an AirCode Ø endorsement, security review, certification, availability promise, or statement that every visitor will have the same experience. Direct stars or messages submitted on a publisher-hosted Showcase are separate private feedback and do not affect the Marketplace aggregate or ranking.

The public Marketplace displays only an aggregate after the minimum sample defined by the Marketplace product contract. It does not publish rater identity or accept review text. We may reject or remove inauthentic or abusive ratings, restrict rating access, and adjust ranking eligibility to protect the Marketplace, provided that we do not represent such controls as verification that every displayed rating is genuine. Account deletion deletes that account’s ratings; listing deletion deletes its ratings. Unlisting, suspension, or plan lapse may hide ratings while the underlying records remain retained for possible restoration and abuse prevention.

7. Reports and safety action

Use Report this app on the public listing to report malware, phishing, impersonation, abusive or illegal content, privacy concerns, source or licence concerns, suspicious donations, seller or price misrepresentation, or app unavailability. An account is not required. Do not include passwords, authentication secrets, or private app data in a report.

We may investigate, restrict, unlist, or suspend a listing or its related public handoff, preserve evidence, and cooperate with competent authorities. We are not required to resolve disputes between you and a publisher, and taking or declining a moderation action does not make us the app’s publisher or operator.

Legal notices may be submitted through https://aircodezero.com/contact and should include the public listing URL. Privacy questions about Marketplace records controlled by Spartacus lab may be sent to privacy@aircodezero.com. Contact the publisher about data controlled inside the publisher’s app.

8. Intellectual property

The Marketplace, excluding third-party apps and publisher material, is owned by Spartacus lab and its licensors. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to browse and use the Marketplace for its intended purpose. No ownership right is transferred.

Publisher names, marks, app content, and linked repositories belong to their respective owners. A listing does not grant you rights to copy, redistribute, reverse engineer, or commercially exploit an app beyond rights given by its publisher, its declared open-source licence, or mandatory law.

9. Disclaimer of warranties

AIRCODE Ø MARKETPLACE AND EACH LISTING, HANDOFF, AND RELATED SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE”. MARKETPLACE APPS ARE THIRD-PARTY SERVICES PROVIDED BY THEIR PUBLISHERS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPARTACUS LAB DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, ACCURACY, SECURITY, PRIVACY, AND FREEDOM FROM HARMFUL CODE.

SPARTACUS LAB DOES NOT WARRANT THAT REVIEW, MONITORING, REPORTING, MODERATION, THE MANAGED RELAY, A BROWSER SANDBOX, OR AN INSTALLATION CONTROL WILL DETECT OR PREVENT EVERY HARM.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPARTACUS LAB WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, MONEY, PROFITS, BUSINESS, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO THE MARKETPLACE, A THIRD-PARTY APP, A PUBLISHER, AN EXTERNAL LINK OR DOWNLOAD, OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPARTACUS LAB’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE MARKETPLACE OR THESE TERMS WILL NOT EXCEED THE GREATER OF CHF 100 OR THE AMOUNT YOU PAID DIRECTLY TO SPARTACUS LAB FOR THE MARKETPLACE APP GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE EVENT.

Nothing in these Terms excludes or limits liability, remedies, guarantees, or consumer rights that cannot lawfully be excluded or limited.

11. Changes and termination

We may change the Marketplace or these Terms for legal, security, operational, or product reasons. Each Terms version will identify its version and effective date. Where required by law, we will provide notice or request renewed acceptance. You may stop using the Marketplace at any time.

We may restrict or terminate access to the Marketplace where reasonably needed to enforce these Terms, protect people or services, comply with law, or discontinue the Marketplace. Provisions that by their nature should survive, including intellectual-property, disclaimer, liability, dispute, and retained- evidence provisions, remain effective.

12. General

These Terms are governed by the substantive laws of Switzerland, excluding its conflict-of-law rules. Subject to mandatory consumer protections and mandatory venues, exclusive venue lies with the competent courts at Spartacus lab’s registered office in Switzerland.

If a provision is held unenforceable, it will be enforced to the maximum permitted extent and the remainder stays effective. A waiver must be in writing. We may assign these Terms in connection with a merger, reorganization, financing, or sale of assets. These Terms and any terms expressly incorporated into a particular Marketplace action are the entire agreement between you and Spartacus lab about your use of the Marketplace.
